Alternative Route for Expungement
I don’t qualify for an expungement under the Oklahoma statutes. Is there anything I can do at this point to get my record expunged? Hi, I’m Oklahoma City Attorney Aaron Easton and that’s the question we have today. And the answer is you do have one route.
So under Oklahoma statutes title 22 section 18 there are many different ways in fact about close to 20 different ways that you can have your record expunged in Oklahoma. And those are very specific based on the type of crime you were charged with, convicted with, and your past criminal record that would allow you to get expungements.
However, if you don’t qualify under any of those specific ways there still is one way that you may be able to get your arrest and conviction record expunged in Oklahoma and that’s through a pardon in the state of Oklahoma. So these are two distinct processes but they do coincide here in one way.
The Pardon Process and Expungement
So if you are able to apply for a pardon through the Oklahoma Pardon and Parole Board and the governor signs off on that pardon then you bring yourself back into the right to have your record expunged and that’s under title 22 section 18 subsection 4 and that’s for Oklahoma residents who have had their record pardoned.
So if you think you might be in that situation if you have more of an extensive criminal background and you think you may not have be able to qualify for a pardon, I’m sorry an expungement, you may have this one route to be able to do that.
